GLOBAL DIGITAL STRATEGY:

Arthur’s Legal is official member of European Committee (EC) Cloud Select Industry Group on enterprise cloud computing & SLA’s (C-SIG SLA), and part of the expert group of five, the ‘Drafting Group’.

The current main results and successes have already been, in collaboration with for instance EC CONNECT, ENISA, EC JUST, Cloud Security Alliance, IBM, Microsoft and Telecom Italia the EC Cloud SLA Standardisation Guidelines (‘Standardization Guidelines’),  as well as accepted contributions to the new ISO/IEC 19086. The Drafting Group continues to be one of the main bodies to contribute to cloud services awareness, adoption and standardisation, both on EU as well international level.

ALLIANCE FOR THE INTERNET OF THINGS (AIOTI):

Arthur’s Legal is Founding Member of AIOTI, Vice-Chair of WG4 (IoT Policies) and rivacy-by-Design Project Leader of WG3 (IoT Standardisation & High Level Architecture) which had been launched by the European Commission and various key IoT players in May 2015. In the DSM strategy the Commission recognised the importance of the data economy. Data technologies and services that can be used for the collection, processing or storage of data (e.g. cloud computing, big data, the Internet of Things), are essential factors of progress in the new era of digitalisation. In the section on “Maximising the growth potential of the Digital Economy” the DSM strategy committed the Commission to proposing a European ‘Free flow of data’ initiative to tackle restrictions on the free movement of data within the EU and unjustified restrictions on the location of data for storage or processing purposes. In addition, it stated that the initiative “(…) will address the emerging issues of ownership, interoperability, usability and access to data in situations such as business-to-business, business to consumer, machine generated and machine-to-machine data. It will encourage access to public data to help drive innovation”. Actors within the nascent European data market need predictability and legal certainty on these emerging issues, not just ‘data ownership’ and the other items listed but also liability arising from the use of data, in order to enter the market and invest in new business models, which is especially vital for European SMEs. Clarity on such emerging issues is also important for all European businesses because they need predictability to assess their current expenditure on research and on product innovation. Existing legal frameworks and current contractual practices may not be sufficient to provide actors in the data value chain with such predictability and legal certainty. Contractual practices may also create obstacles to the free and smooth flow of data or to data access as well as lock-in effects. The European Free Flow of Data Initiative is an important step at EU level to allow businesses, citizens, researchers and consumers to take full advantage of data technologies and services, such as better access to cloud services and better data analytics. A free flow of data will support connectivity between sectors and industries, lowering costs, stimulating research and innovation and unleashing the potential of new economic models.

OTHER RECENT PROJECTS & ACTIVITIES:
SLA Ready: EC has granted the two-year H2020 project regarding cloud computing and Service Level Agreements (SLAs) called ‘SLA Ready’ to the strong consortium: Cloud Security Alliance (EU), Technical University Darmstadt (DE), Trust-IT Services (UK/IT), Numergy (FR) and Arthur’s Legal.

The main goal is to make (potential) business users in the EU aware of the opportunities, risks and rewards of cloud services and related SLAs, and making those services and SLAs usable for all to benefit from. With the Digital Economy as top priority of the new European Commission, this are quite interesting times. Privacy Level Agreement (PLA): Arthur’s Legal is a member of and contributor in the PLA Working Group of CSA, a team of data protection law processional familiar with cloud services (including several national Data Protection Authorities). The current deliverable that the WG has been working on is PLA v2 (to be make publicly available soon), which helps companies and organisations with a comprehensive framework on mandatory privacy laws and regulations in the 28 Member States of the EU, and provides them with a tool to evaluate achieving EU wide data protection. The level of privacy compliance is key; being 100% compliant in all cases is not. It is about being at least compliant on the mandatory laws and regulations.

A powerful self-regulatory tool to help cloud customers better understand and evaluate cloud service providers in the EU is now available herefree of charge.

Ars Technica: Recently Arthur’s Legal was invited as expert by Ars Technica in its expert panel on the Future of Cloud. In the particular live chat the main topic was ‘Taking back privacy in the cloud’. Together with Ars Technica IT Editor, Sean Gallagher as moderator, the Electronic Frontier Foundation, New Jersey Institute of Technology and Arthur’s Legal joined forces to discuss this interesting, and complex topic. Futhermore, Arthur’s Legal is admitted and contributing as expert at for instance Sprout, Dutch Cowboys, De Ondernemer & Tijdschrift IT Management.

Cloud Architects Alliance: Arthur’s Legal is part of the expert panel of the Cloud Architect Alliance conference, and continues to supporting and lecturing several governmental of departments about cloud computing. Main takeaways from this session: #Ethics, assurance, standardisation and certification as key enablers for both CSPs and customers.

Triple Play @ Cloud Expo Europe: This year at the Cloud Expo Europe in London, Arthur’s Legal contributed three times. live on stage (Business Theatre), as always multi-angle-tailored, for both CSPs and other vendors, as well as current or future cloud customers:

1. Arthur’s Legal chaired the panel dialogue with Spanish based CSP Nexica and Canadian based backup expert Asigra about cloud security from a multi-angle, 3D perspective; what are the different implications of private, hybrid and private cloud, for CSPs, ecosystems and customers.2. Arthur’s Legal joined Microsoft and Computer Business Review in the panel dialogue about data and regulatory issues concerning privacy: What do CSPs, ecosystems and customers need to understand.

3. Arthur’s Legal as consortium partner of @SLAReady took the audience on a vibrant journey about Service Level Objective checklists, SLA life cycles, standardisation, perception & facts, Experience Level Agreements, SLAs-for-a-day, USPs and market making, both on EU as well international level.

Main takeaways from this session: #Lack of understanding, possibilities and challenges is the main reason for slow uptake. #Experience of customer more important that most CSPs think. #Service and SLAs as the differentiator.

Cloud Banking Europe in London was another excellent event especially as many banks participated, including the major banks from all over Europe, including its C-level representatives and cloud architects.

Arthur’s Legal joined HP, ABN AMRO and Mason Pinsent on stage in a panel dialogue about hybrid cloud, standardisation efforts of both EC, ISO and CSA, Arthur’s Legal is all collaborating with, as well as SLAs, secSLAs, 3D Data, PLA efforts, privacy-by-design, certification, and upcoming cloud insurance and scalability.
